Law

The term Law has several different meanings. In common legal theory, it pertains to a body of decrees, statutes, and rules set forth by a specific ruling body and is enforced violently. The less common context is related to the notion of Natural Law, which seeks to find the underlying principles common to all ethical systems in order to rationally derive the most essential, enforceable keys to facilitating peaceful coexistence among humans that does not fundamentally involve violations against a core set of rights which are regarded as intrinsic to the individuals involved.

The term “Law” is also often used in the context of defining firmly established, immutable patterns which govern the forces of nature, such as with the laws of physics.

Definitions:

Legal/Positivistic

  • Nominal:
    A series of rules, statutes, and decrees set forth by a governing body. Also the individual instances of these statutes.
  • Essential:
    A subset of the category of customs intended for restricting and controlling human behavior that is issued and enforced by a ruling body.
  • Efficient Cause:
    A body of rules issued by a specific ruling body, with the intended goal of engineering social behavior in such a way that is conducive to that governing body's desires.
  • Final Cause:
    A set of rules enforced through violent means.
  • Material Cause:
    These types of laws are abstractions, and only have substance proportional to the belief of their issuers, enforcers, and subjects.
  • Effects:
    Limited, just laws can help to promote a peaceful society, while unjust, which are often complex, legal codes foster corruption and social strife.
